Terms of Service

These Terms of Service ("Terms") govern your access to and use of Quantum Habits OS (the "Service"), operated by Quantum Habits OS ("we", "us", "our") at app.quantumhabits.online and quantumhabits.online.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use Quantum Habits OS. By using the Service, you confirm you meet this requirement. If you are using the Service on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.

2. Account registration

• You must provide a valid email address and create a secure password.
• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity that occurs under your account.
• If you suspect unauthorized access, notify us immediately at [email protected].
• Each account is for one individual. You may not share your credentials.

3. Subscriptions and payments

3.1 Subscription plans

Paid plans available:

• Monthly: $29/month, billed monthly. Includes a 7-day free trial.
• Annual: $249/year, billed annually (~$20.75/month).
• Founding Member: $499 one-time. Lifetime access, limited to 100 seats.

3.2 Billing

Payments are processed by LemonSqueezy, our Merchant of Record. All prices are in US Dollars. By subscribing, you authorize LemonSqueezy to charge your payment method on the applicable billing cycle.

3.3 Free trial

The monthly plan includes a 7-day free trial. You will not be charged during the trial. You may cancel before it ends without being billed.

3.4 Cancellations

• Monthly/Annual: You may cancel at any time. Cancellation takes effect at the end of your current billing period. No prorated refunds for unused time, except as covered by the 30-day refund policy (Section 4).
• Founding Member: One-time purchase. Not eligible for refund after 30 days.

3.5 Price changes

We may change subscription prices with at least 30 days' notice. Continued use after the effective date constitutes acceptance.

4. Refund policy

We offer a 30-day full refund on all new purchases. If you are not satisfied within 30 days of purchase (including Founding Member), email us at [email protected] and we will refund in full. No questions asked.

After 30 days, refunds are at our discretion for exceptional circumstances.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or extract the source code of the Service
• Resell, sublicense, or redistribute access to the Service
• Use automated tools (bots, scrapers) in ways that place unreasonable load on our infrastructure
• Upload or transmit malicious code, viruses, or software that may damage the Service or other users
• Use the Service to harass, threaten, or harm any person
• Impersonate any person or misrepresent your affiliation with any entity

6. Intellectual property

6.1 Our property

Quantum Habits OS, including its design, code, methodology (NS state framework, Identity Lab, habit architecture), branding, and all content we create, is our intellectual property. These Terms grant you only the limited right to use the Service as described here.

6.2 Your content

You retain full ownership of all data and content you enter into the Service (journal entries, habit logs, task data, Smart Hub content). You grant us a limited, non-exclusive license to store and process this data only to provide the Service to you. We will not use your personal content to train AI models, for advertising, or for any other purpose.

7. Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

8. Disclaimers

Quantum Habits OS is a productivity and self-development tool. It is not a medical device, healthcare provider, or mental health service. The NS state methodology (ALPHA / DELTA / OMEGA) is a behavioral self-assessment framework. It is not a clinical diagnostic tool and is not a substitute for professional medical, psychological, or therapeutic advice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

11. Termination

11.1 By you

You may terminate your account at any time through app settings or by contacting us. On termination, your access stops and your data is deleted within 30 days.

11.2 By us

We may suspend or terminate your account if you have violated these Terms, engaged in fraud, or pose a security risk to the Service or other users. We will provide reasonable notice where possible.

12. Modifications to the service

We may modify, suspend, or discontinue any part of the Service at any time. For Founding Member lifetime access: we commit to maintaining core functionality for at least 5 years from purchase, subject to circumstances outside our reasonable control. If we permanently discontinue the Service, Founding Members will receive a pro-rated refund.

13. Governing law

These Terms are governed by applicable law. Disputes will be resolved through good-faith negotiation. If unresolved, they will be submitted to binding arbitration or the competent courts in the jurisdiction where we operate.

14. Changes to these terms

We may update these Terms periodically. For material changes, we notify you by email or in-app notification at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
